Acceptance of Terms

By booking a trip with Restless Lady Fishing Charters ("Restless Lady", "we", "us") or using restlesslady.com, you agree to these Terms of Service. If you don't agree, please don't book a trip or use the site.

These terms apply to all guests aboard the vessel, including anglers, non-fishing companions, and minors under the supervision of a parent or guardian.

Services

Restless Lady operates USCG-certified sport fishing charters out of Ocean City, Maryland. Services include private charter bookings and open boat per-person seats for day trips, offshore runs, canyon trips, overnight trips, and tournament charters. The Captain has final authority over vessel operations, fishing grounds, and trip duration.

Booking & Reservations

You can request a reservation online through the booking calendar or by phone. All reservations are tentative until a Captain confirms availability and collects the required deposit.

USCG regulations limit us to 6 anglers per trip. Kids and non-fishing guests count toward this total. You must be the party's primary contact and at least 18 years old to book a charter.

Payment & Gratuity

Private charter deposits are $500 for day trips and $800 for overnight trips, due at booking. The balance is due at the dock at the start of your trip and can be paid by cash, check, or credit card.

Open boat seats are paid in full at the time of booking.

Mate gratuity is not included in any trip price. Charter mates are paid through gratuity, not salary — customary gratuity is 20% of the charter rate, handed directly to the mate at the end of your trip. This is standard on every charter boat.

Fish cleaning is available at the dock for a separate fee paid directly to the cleaners. It is not included in the charter price.

Cancellation Policy

• Customer cancellations 21+ days prior to the trip receive a full deposit refund.
• Customer cancellations within 21 days forfeit the deposit unless we can fill the slot with another guest.
• Charter-side cancellations due to weather or mechanical issues are rescheduled within the current season or carried forward to the following year. No deposit is lost.
• Open boat seats follow the same timeline — full refund 21+ days out, forfeit within 21 days if the seat cannot be resold.

Weather & Captain's Call

Safety comes first. The Captain has sole discretion to cancel, shorten, or delay trips due to weather, sea conditions, mechanical issues, or any factor that could put the vessel or guests at risk. A cancellation by the Captain is not a breach of these terms and will be rescheduled per the cancellation policy above.

Guest Conduct & Safety

All guests must follow the Captain's and mate's safety instructions at all times. We reserve the right to end a trip early, without refund, if a guest engages in any of the following:

• Unsafe behavior on deck or around equipment
• Excessive intoxication or illegal drug use
• Harassment of crew or other guests
• Damage to the vessel or its equipment
• Ignoring safety instructions

Non-prescription drugs are not permitted on the vessel. Alcohol consumption must be moderate and does not excuse responsibility for damages or conduct.

Assumption of Risk & Liability

Sport fishing involves inherent risks including but not limited to rough seas, slipping on wet decks, hook and line injuries, weather exposure, and seasickness. By booking a trip, you acknowledge these risks and accept them on your own behalf and on behalf of all members of your party.

To the fullest extent permitted by law, Restless Lady Fishing Charters, its captains, crew, vessel owners, and affiliates are not liable for any personal injury, illness, property loss, or damages arising from your participation in a trip, except to the extent caused by gross negligence or willful misconduct.

We carry appropriate liability insurance as required by USCG regulations. All personal belongings are brought aboard at your own risk.

Intellectual Property

All content on restlesslady.com — including text, photos, logos, and video — is the property of Restless Lady Fishing Charters or its licensors. You may not reproduce, distribute, or use this content for commercial purposes without written permission.

Photos the crew takes during your trip may be used on our website and social media for promotional purposes. If you prefer we don't post photos that identify you, let the Captain know at the dock.

Governing Law

These terms are governed by the laws of the State of Maryland and applicable federal maritime law. Any disputes will be resolved in the courts of Worcester County, Maryland, or the U.S. District Court for the District of Maryland, as appropriate.

Changes to These Terms

We may update these terms from time to time. The "Last updated" date at the top of this page reflects the most recent version. Continued use of the site or booking a new trip after changes are posted constitutes acceptance of the updated terms.
